Copyright Permissions, Warranties and Indemnities
Authors who submit their work to the Journal for publication agree they have read and accept the terms set out below prior to submitting their work for publication. In the event the terms below are unacceptable, authors must not submit their work for publication and must either notify the Journal, in which a bespoke agreement may be agreed with the Journal prior to publication, or do not submit their work for publication:
1. Authors warrant it has obtained all necessary licence, permissions or rights to copyright subsisting in the works and hereby grants the Journal a perpetual, royalty free, irrevocable, world-wide non-exclusive licence to publish the work, use or otherwise communicate the work to the public.
2. Authors may be required to provide relevant documentation that they have sought proper licence/permissions etc. noting here that there is a responsibility on the Journal to make reasonable enquiries.
3. Authors grant the Journal the right of first publication with the work and simultaneously licence the work under a Creative Commons Attribution - 4.0 International Licence to allow others to share the work with an acknowledgement of the work's authorship and initial publication in the Journal.
4. Authors are able to enter into separate, additional contractual arrangements for the non-exclusive distribution of the Journal's published version of the work (e.g., post it to an institutional repository or publish it in a book), with an acknowledgement of its initial publication in this Journal.
5. Authors are permitted and encouraged to post their work online (e.g., in institutional repositories or on their website) prior to and during the submission process, as it can lead to productive exchanges, as well as earlier and greater citation of published work.
6. Authors shall release, discharge, and indemnify the Journal and its personnel from and against any loss, damage, liability, cost or expense (including legal expenses) suffered or incurred by any of them, whether in contract, tort (including negligence), or otherwise in connection with:
a) any failure by the authors to comply with applicable laws; and
b) claim by a third party that any use by the Journal of the work in accordance with the above terms infringes the intellectual property rights (including copyright and moral rights) of a third party (IP Claim); however
c) in the event the Journal contributes to the liability or breach in the IP Claim, the authors liability shall be proportionate to the extent of the Journal’s contribution to that liability or breach.
7. In the event there are two or more authors, the expressions ‘author’ or ‘authors’ will apply collectively to all authors, and:
a) Each co-author is jointly and severally responsible for the obligations above which apply to each co-author individually and to the co-authors collectively and the Journal shall not be bound by any separate or legal relationship as between the co-authors; and
b) Each co-author hereby warrants and represents that the author or authors who submitted the work for publication on the Journal (Submitting Authors) has full right, power and authority to act on their behalf, and that they shall be bound by the Submitting Authors with respect to all matters, notices and communications in connection with the publication of the work including without limitation the obligations above.
8. For the avoidance of doubt:
a) reference to ‘work’ or ‘works’ as it relates to copyright includes all materials provided or submitted by the author to the Journal for publication on the Journal, including without limitation, the article, images, figures and diagrams.
b) reference to ‘journal’ refers to the International Journal for Crime, Justice and Social Democracy, which is a part of the Queensland University of Technology, a body corporate established under the Queensland University of Technology Act 1998 (Qld).
